It looks like they used the same generic stock icon vector file. How about they are both generic and ugly, so who really cares?

Matter of opinion, though in honesty, I dont like either of them. What does matter though is that it is a rip, no matter of the simplicity, and after all we’re talking about a logo. Logos tend to have to conform to rather simple standards as they have to be easy/cost effective to print, as in the least number of colours possible.
Basing a designer’s right to protection on the sole basis of whether they reach certain peoples aesthetic values is a little unreasonable, wouldn’t you think?

Nope, the original is from Ubuntu Linux from a company called Canonical, it is extremely well-known in the IT world and is most certainly original. Their logo gets ripped off a lot (it was even ripped by MSN Spaces), to the point that it’s becoming ridiculous, so I guess a lot of people disagree with you on it being ugly
