Monaux Skeg Rip

So a while back I commissioned Monaux to do a design for my label Skeg. I got it printed a while back through Storenvy along with the rest of my line however I have a slight problem. You see when I sent the files over to the printer I received word from Storenvy that they had printed this design already with different a text (a clear rip). The only information I have is his mailing address and email.

I’ve contacted Monaux and he is unsure as to what to do as it’s quite difficult and costly to take someone to court over something like this. I already got my design printed as I still really wanted to print it, but what should I do about the guy who already printed 50 of his ripped design.

    How would this other guy get a hold of the image ahead of you if it was commissioned specifically for your brand? Are you sure your artist didn’t rip it instead? (I’m not saying that’s true, it’s just odd.)

    I also gotta say that this is a bizarre choice for tees. Does it actually sell well? It’s like she’s shooting mucus out of her mask. Gross.

    Great image – the rip also looks as if it’s been live traced – not as sharp.
    What was the outcome? Did you find out the truth?

    yeah dog, it doesn’t make sense that if you had artwork drawn for you, no one else would have it, especially long enough for them to go ahead and print shirts before you could. use some logic.

    yes you might have to clarify how they got the image before you sent it to the printers…though the second, as been pointed out is obviously a copy of the Skeg…except that text has been clumsily shoe horned in…the skeg being incorporated…

    Yes, looking at the text I’d put my money on Monaux for making the original.
    It’s strange that someone got hold of his drawing though, but maybe Monaux temporarily put it on his blog or Flickr, and this 18 year old kid ripped it off to make some shirts for himself.
    But it’s a coincidence that he used the same printer to make the shirts. Does he live in the same area or is this a famous printer?

    “Password” might be a hint eh.
    Time to review your contacts and who you are dealing with.
    I couldn’t completely follow the order of events you described but you should review who else *could* get at it from the moment it leaves your computer.

    hola!! primero, buenisima la pagina …
    la verdad es que es muy triste ver como los diseñadores, que siempre llenan sus bocas hablando de creatividad… terminan por copiar elementos que no son propios.

    de todas formas no pasa en todos los casos que se muestran aca…
    en algunos puede ser una adaptacion de un elemento sobre otro contexto y un uso totalmente diferente al original. tal vez hasta con consentimiento del original…

    mmmmm.. no me gusta creer que la gente es tan estupida…

    This is a really weird case.

    1.- How the hell others got your design before you comissioned it? It hint that Monaux was the one who ripped.

    BUT 2.- The style of the drawing is actually similar to Monaux style (I browsed his website), the face lead us to Monaux style and is present in both drawing without changes, so leads the other designer copied it and just resized body parts to make it more cartoonish.

    AND 3.- Monaux design is “complete” while the other one looks like the dude cut the image to the part where the word Skeg ends adding that Password thingy to cover it leading to the fact that he doesn’t know how to drawn because he couldn’t managed to redraw the end of it and just covered it (wtf password?).

    AND FINALLY 4.- Monaux design have way more detail than the other one, it’s illogic to think that he copied it from a very simple art-line to end up with that one. Sometimes happens, but rarelly.

    And if Monaux is the one who stole, he had such a good luck finding a drawing with similar style as him and also he managed to improve it a lot… But still, lame rip is always lame.

    Maaike have a good point, maybe you got ripped too dude. Like Monaux used a very old drawing and just edited it for you and charged you for a full design drawing, this happens a lot too. But for Monaux misfortune, someone got the drawing before he could delete it from his website and ripped of it. That will explain why he doesn’t know what to do: Admit he ripped of you to demand the other dude but putting himself on risk by being sued by you or just shut up scared of the possibility of being sued but putting is career in risk because he will look like the one who stole (after all everything looks like the second design come first because of the story you are telling us).

    I did not rip anybody off. I put the image up on my site prior to it being printed, and this Password dude stole it.

    Yeah that’s basically what happened, had no luck in emailing the guy he replied a few times then just stopped talking about it.

    Here’s what he said the shirts are for then he never replied back after that.

    “Regarding the use of the shirts, well as I said, we are a small non lucrative association, we’re formed of about 15 active members and we’re organising activities for childrens around 8-12. We use to have yellow and blue shirt with a black logo on it to be notified as a member of the Staff but we tought about doing new shirts and then it goes.

    I could send you some pictures of our activities”

    Also Storenvy is a pretty popular printer, still a big coincidence that we both went to print with it though.

    Is there anything we can actually do about this?

    I’m going with the old Monaux work charged as commissioned piece. Cat was let out of the bag because someone (who i very much concur with) thought it was a bitchin’ design.

    I find it very good policy to not post commissioned work on your website [Monaux] until it is being used by the person who commissioned it. Just because people pull this shit and you want the person who paid for it to come out with it first.

    You could sue this person; very costly and time absorbing.
    And you need to prove they made money with it to get anything from them. It’s not worth it unless they are really big.
    I would just go to print with it and let it go.

    Yeah, I’d go with that. Pretty foolish to post a commissioned work before it’s been “published” (printed, in this case).
