ASOS have copied a Russian Doll design by Lady Luck Rules OK

This morning I received an e-mail from one of our customers who was looking through the ‘New In’ section of the ASOS website when a Russian Doll ring caught her attention which looked VERY similar to our design. My heart sunk as I clicked on the link to discover it really is a blatant horrendous cheap rip off of our original artwork! The design and even the wording are copied, we have been selling “I’m Cute” Russian Doll necklaces on the Hannah Zakari website since September 2008. We originally designed the Russian Doll jewellery in August 2008 for a Viktor & Rolf “Dolls Night Out” party held at the Barbican. We took inspiration from trips to a Russian Tearooms in Primrose Hill and a houseboat community in Victoria Park. We then spent a long time lovingly drawing our own Russian Doll design. I feel so angry about this! Surely a *huge* company like ASOS have a large in-house design team earning big bucks to create their own brand products – why copy designs by small independent designers? It’s so, so lazy. ASOS you suck! You’ve left us with no option but to name and shame you but do you actually care?

Their russian doll rip-off seems to have vanished though.
Yes we have contacted them and they have removed the ring from their website while they discuss the matter with their “supplier” (even though it’s an own brand product. We took a screengrab before they took it offline – http://www.twitpic.com/y72va
I think this is a great fear of most small designer makers, that the big boys seem to think they can pretty much do as they please and no one will notice or do anything about it. Well done for contacting them and letting them know they can’t get away with it.
I am so, so sorry this happened to you. It is sickening – especially since they hope they will get away with it. Extremely scared this will eventually happen to me as well once I am back on Etsy full-time… indie designers just don’t have the funds to have a lawyer ready at all times.

“Russian Doll” as a basic concept has been around for ages. It is quite another to make a poor facsimile of one design and pass it off as original.
I have worked with asos in the past and as far as im aware they don’t have a design department, they come to design-houses or directly to manufacturers with images or samples of clothing/accessories that they want reproduced for them under their own label, they leave the designing/copy-right infringement to them.
Of course they approve the designs in the end and it is very likely that they went to their manufacturers with the Lady Luck Rules design in the first place.
Im just shocked at how ugly the reproduction is, given how cute the original is!
