Lady Pirotessa has moved on to copying two other artists. One is Matthew Nix of Nixcreations and the other is Dr Brassy Steamington of Dr Brassyssteampunk. Lady Pirotessa doesn't have a single piece that she has not ripped off of someone else. Not ONE. She has moved off Etsy where she gets caught quickly and reported, to Deviantart and Zibbet where Copyright Violations are ignored. She mutes anyone who outs her copying.

I frequent this blog and often side with the "little guy" when it comes to intellectual property rights violations, but I have to say, I don't think this is as cut and dry.

First of all, morals/ethics aside, there is nothing illegal here. There are no grounds for legal action or a lawsuit unless Twistedsisterarts has full rights to all wire wrapped "evil eye" style jewelry (which I would bet anything she does not). Wire wrapped evil eye jewelry is not exactly common-- for example, you probably won't see it at your local Walmart-- but plenty of sellers on Etsy and elsewhere make this style of jewelry. The only difference is that Bluerosescreations happened to buy a piece from Twistedsisterarts before getting into jewelry making.

You've insinuated that Bluerosescreations has methodically and intentionally tried to copy the exact design that she purchased, and so what if she has? Maybe it shows a lack of creativity, perhaps questionable ethics, BUT THERE IS NOTHING ILLEGAL HERE. So please, spare us the suggestion of a lawsuit, because there are no grounds. Similarly, there is nothing in Etsy's policies that has been violated either, so the shop will not be shut down. It's as simple as that.

Also, there is a huge ASSUMPTION here that Bluerosescreations actually reverse engineered the piece in question. It's possible she was only inspired... after all, the two pieces have plenty of differences. And as I mentioned before, Twistedsisterarts is just one of the sellers who designs and makes this style of jewelry, she did not invent the wire-wrapped evil eye. There are also plenty of free tutorials online detailing how to make this kind of jewelry that Bluerosescreations could have used.

Even if she did use the piece she bought to learn how to make it, that would not suggest that she has "no talent" as has been written over and over again here-- in fact, quite the opposite! To reverse engineer something-- in other words, to figure out how something is made when you (allegedly) possess no prior skills in making that type of piece-- is NOTORIOUSLY difficult and would suggest IMMENSE talent on the part of Bluerosescreations... so your accusations are actually backfiring on you if you are attempting to insult her and her level of talent.

Finally, while I don't think this is as big of a deal as it's being made out to be here, if you are one of the people who do think this is such a massive offense, why would you stoop to the level of the alleged offender and harrass her on every venue possible? Not only does it make you look bad, it is also a waste of your time that could have been spent doing something productive and a SEVERE case of the pot calling the kettle black, if you will. Just because there is no legal recourse (because again, no laws have been broken) does not mean you should take it into your own hands and attempt harass and attempt to defame someone out of revenge for ALLEGEDLY copying your work.

In the end, I don't think that Bluerosescreations is really hurting Twistedsisterarts business that much. Twistedsisterarts has over four times the amount of sales as Bluerosescreations on Etsy and twenty times the admirers (people who have favorited the store). Twistedsisterarts' items come up before any other evil eye jewelry in Etsy search. Most importantly, their designs are different. The two pictured above are perhaps the most similar, but if you look at the two shops, the designs in each have marked differences. This is the nature of business; to have competition. Much like some prefer Pepsi and some prefer Coca Cola, customers have the choice of which item they like better. If someone buys an evil eye necklace from Bluerosescreations, it is BECAUSE THEY LIKE THAT NECKLACE BETTER THAN ONE FROM TWISTEDSISTERARTS.

If you're going to sell on Etsy (or just be in business as a whole), you're going to have to get used to competition. This isn't an issue of copyright, as there was no exact copying going on here. This is an issue of accepting competition (the nature of the beast in retail/business) and behaving maturely. When you make a product that is popular, people are going to compete with you and create products in a similar style, which is what happened here. The answer is not to retaliate like a child who has been pushed on the playground. If you really are as talented as you claim to be, and your competition is not, then you'll always be able to stay ahead of the curve with new designs and ideas for your business. But every second you waste being petty, stalking the competition's facebook page or attempting to "out" them as a "copyist" is a second that you could have used to better your business in a productive way. Just keep that in mind.

Twistedsisterarts says her artwork is being copied and stolen but if there are tutorials out there, then it isn't stealing, even if Abluerosescreation bought one at some point in the past. Basically what is needed here is a patent. Does Twistedsisterarts have one?

About their color shifting eyes. Abluerosescreation started their eyes with color shifting qualities to one degree or another. Not one or two but all of them. Now Twistedsisterarts is doing color shifting glass too? And on most of her new pieces? Looking back through her artwork, this is a new thing which came about after the other store.

You cannot get on a high horse about someone stealing something of yours, and then turn right around and do the exact same thing to the same person. It destroys your credibility. This makes Twistedsisterarts a hypocrite, plain and simple. And that is worse than a copyist in my opinion.

Wire work is a competitive market but should also be fun. Mud slinging is ridiculous and blows things out of proportion. Did Avon and Mary K go through this? You Bet.

Update: The long arm of the law caught up with our little Copyist. Her Etsy sold items now show sold listings as "No longer available" with no photo. Hummmm

Your honor, yes I bought an eye from an Etsy seller and had never done eye jewelry before and in fact just sold makeup, yes I reverse engineered that same piece that I bought but I took a class in wire wrapping too! Yes I started making copies of the artist's original work and yes I even reverse engineered the painting of the eyes (no class exists on this and it is a trade secret) and yes I name my jewelry pieces the same exact names she does and yes I use the same tag words on my Etsy shop. And yes the original artist has been doing her art for 4 years before I bought a piece from her, But I didn't copy, and my husband says I should be able to do whatever I want, so there!

Yea, sounds reasonable to me. I would love to be the judge in this case. Oh wait, hubby bubby doo-dah says he wuves her and it's aok by him, so screw the law on intellectual property, copyright, simple morals or personal responsibility.

Holy crap! Blueroses copies Twistedsister wirewrapped eyes, and she directly copies the naming of them on Etsy (Gothic Steampunk Dragon Evil Eye Color Shift Creepy) AND interestingly enough, the tag labels too. Take a look for yourself. Woman is a total rip off of original artist. Sue her.

IMHO non of these is Steampunk. Just trying to jump on a bandwagon to sell something.

Over 8,000 fans on Etsy alone and the copyist husband thinks everyone who sees his wife's fraudulent copies and has something to say about it, is Jill. To Jill. I hope you know that your fans support you and understand the financial loss and emotional distress that this fraud has enacted against you. Now that you have proof and a public statement from Micha's husband that Micha did purchase one of your eyes before she ever had a single piece of jewelry in her shop, it is hoped that you will sue her. Micha can't move beyond doing the wire wrapped eyes, because all she can do is try to copy what you have done Jill. You started using stampings and it was not 1 week before Micha started using stampings with her eyes. We will never see anything original from Micha because there is no real talent there. Husbands will defend their spouses even when they know that the action being perpetrated against another is nothing but immoral, unethical, GREED. If you don't pursue action against Micha in a court of law, it is hoped that all the negative energy, greed and deceit will come back to Micha times 3.

My response to Robert H: Hi Jill.
Your first question is silly. I think it's relatively clear in this context that when I said she bought a piece, she bought a piece from you. It's also silly because you're Jill, so you already know this. Asking me to be truthful in my responses is also silly and rude. No one has any way of verifying the truth of what someone is saying here. It's up to the reader to determine if they believe the statements. Asking me to be truthful is just implying that I wouldn't be otherwise, and that's insulting.
To answer your second question, no, Micha did not post sketches of your work copied from your store on her facebook account. She posted a sketch of some of her thoughts on designs she might want to try, including two hairpins, two side eyes, and two hanging pendants. The sketches are simple, and are not of sufficient quality to be exact copies of anything, nor were they intended to be. Others who are reading this can see the image here at http://www.facebook.com/photo.php?fbid=303368483029369&set=a.303368313029386.76622.170481426318076&type=3&theater and see for yourselves. You can also see that the picture was posted on December 8th, 2011 and was not removed. But you see, Jill, the reason you have a screen shot of it is because you were the one spamming her facebook page. And the reason you think it's been removed is because the account you were using to spam her pages was blocked.

My response to Keith T.: Hi Jill.
You posted a message supporting yourself within 1 hour of your previous post on a comment thread that sees action once every few days, and you did it using the same talking points you've been using in your emails and spam messages. You already know she bought a piece from you, and I think anyone reading this string of comments understands that as well from what we've been stating. I also explained earlier "She purchased tools, bought herself a tutorial, watched a few youtube videos, and next thing you know, my wife is spending her evenings wrapping wires and painting eyes." You keep saying that she took your eye and learned to make eyes from that. (Micha, when you read this, I mean no disrespect) Jill, she's just not that good at this. She had to follow tutorials to learn how to wrap wire into such complex patterns. If she could have done it just by looking at your eye, that would have been astounding and it's sort of a compliment that you attribute that skill to her. That's not how it happened. It would be like learning to knit by buying a sweater. It just doesn't work that way. Someone's gotta show you how to knit. Now that she's gotten some lessons and some practice, mind you, her work is amazing. Seeing her constantly improving her skill has been a pleasure to see and I'm very proud of her hard work and that it's paying off so well. She's put a lot of effort to get where she is now, and despite the insults and accusations, she's earned her place.

Jill, what I wrote above is still true. I'd rather not repeat myself overly much, but this is an art style, and you don't own it. This anger is gonna eat you up. You gotta let it go.

To any reading, I'll check back from time to time and answer any questions I have.

I also explained earlier “She purchased tools, bought herself a tutorial, watched a few youtube videos, and next thing you know, my wife is spending her evenings wrapping wires and painting eyes.” You keep saying that she took your eye and learned to make eyes from that. (Micha, when you read this, I mean no disrespect) Jill, she’s just not that good at this. She had to follow tutorials to learn how to wrap wire into such complex patterns. If she could have done it just by looking at your eye, that would have been astounding and it’s sort of a compliment that you attribute that skill to her. That’s not how it happened. It would be like learning to knit by buying a sweater. It just doesn’t work that way. Someone’s gotta show you how to knit. Now that she’s gotten some lessons and some practice, mind you, her work is amazing. Seeing her constantly improving her skill has been a pleasure to see and I’m very proud of her hard work and that it’s paying off so well. She’s put a lot of effort to get where she is now, and despite the insults and accusations, she’s earned her place.

Jill, what I wrote above is still true. I’d rather not repeat myself overly much, but this is an art style, and you don’t own it. This anger is gonna eat you up. You gotta let it go.

To any reading, I’ll check back from time to time and answer any questions I have.

That's what I want to know. The husband is intentionally vague about his wife "purchasing a piece". Why doesn't he come right out and say that his wife bought an eye from Jill and then saw how she made it, and then started making her own copies. I will be interested in seeing the response to the question above. Well "Husband". Did your wife buy an eye from Jill? Yes or No?

Two question for Micha Cole's husband. Did Micha buy an eye from Jill at Twistedsiserarts on Etsy. Answer this question truthfully. Did Micha on her Facebook account post sketches of Jill's work (hair picks with eyes) taken directly from Jill's Etsy shop. (It has now been deleted but we have the screen shots).
